Texas Court Denies Emergency Abortion In Medical Crisis For Women
The Texas Supreme Court has overturned a prior ruling that granted permission for a pregnant woman to undergo an emergency abortion. This medical procedure to abort the baby was going to take place under the provisions of the state’s medical exception to the stipulated ban on abortions.
This reversal came after a petition from the Republican Attorney General, Mr. Ken Paxton. This petition apparently challenged the basis on which the state was allowing emergency abortions. Currently, the points under which the exertion exist fall under the restrictive framework of Texas law.
Hours after lawyers provided representation to Kate Cox, a woman looking to get an abortion, this recent development took place. Kate has stated that she is going leave the state of Texas to avail the abortion.
However, she still aimed to continue with her lawsuit for abortion rights after the Texas Supreme Court issued a ruling that was unanimous in nature.
Cox had also emphasized that her fetus was facing a fatal diagnosis. As a result, continuing the pregnancy was to pose risks to her health and future reproductive ability.
The high court, comprising nine Republican justices, stated in an unsigned opinion that Damla Karsan’s opinion on the case was simply not enough. Karson is a doctor who was actively involved in the abortion and Cox’s lawsuit. It is Karson’s “good faith belief” about the procedure’s medical necessity that the court did not deem to be sufficient for Kate to get an abortion.
