Needless to say, this is the most common type of real estate contract. Why? Well, that’s it guarantees the agent their commission for the work they have done.

And because of that, they put in the maximum effort. For instance, while they might not use their marketing skills to the fullest in an agency agreement, they will do that in this case.

Additionally, you do not have to think about the negotiation for the closing deal. This is also something that the agent will do as they try to get the best deal for you!

Cons of Exclusive Right to Sell

  1. No Way to Avoid Commission: This is the major problem with this form of an agreement. No matter what you do, you will have to pay the commission to the agent. Yes, even if you get your buyer yourself!
  2. Less Control Over the Sale: Secondly, considering the fact that the agent has complete power over the way they want to sell or list your property for the contract period, it leaves you with little or no rights.
  3. Long-Term Commitment: The lock-in period of this agreement is also a major problem with most property owners. Therefore, if the contract lasts for several months, you will not be able to switch to another agent.

You must have already understood by now that there are two primary differences between exclusive agency and exclusive right to sell. The first is the point of commission, and the second is how much power they have over the property.

Here are some of the major differences between the two forms of contract in the real estate selling process:

  • In an Exclusive Agency agreement, the property owner will have to pay the commission to the agency that they have decided on only if the agent is able to ring the buyer. If not, then there is no need to pay the commission
  • In the case of an Exclusive Right to Sell agreement, the property owner has to pay the commission that was decided between them and the agent, no matter what happens. This means that even if they get the buyer themselves, the agent gets the commission.

And trust me when I say that all other points of difference stem from this one. For instance, if the agent knows that he or she is going to get the money, they will put in 2x effort in ensuring that they are able to close the deal at a better price.

However, if there is no such guarantee, they will not show that amount of dedication when it comes to listing your property and marketing it.

  • Both of these are contracts that need to be signed by the owner and the agent or broker to be valid.

This is a very common thought that most people have. And whenever someone has asked me this question, I have only one answer: It depends!

For instance, you can choose to get into an Exclusive Agency contract in the following cases:

  • You have the confidence that you can find a buyer by yourself.
  • You’re experienced enough in the market of real estate to know how to sell the home effectively without much help.
  • You do not want to get into the whole point of giving a commission to the agent.

On the other hand, you can choose to get into an Exclusive Right to Sell contract if you:

  • Want to have an agent who has a lot of experience in the real estate market.
  • Do not want to go through the hassle of searching for buyers for your property.
  • Want to have a smoother process in the selling of the property.
