On Thursday, Texas Attorney General Ken Paxton issued a stern warning. He claims that the state will prosecute doctors participating in facilitating an emergency abortion.

This statement stands directly challenging a court order that had granted a woman the right to undergo the procedure for medical reasons. The court granted this order hours before Paxton’s statement.

The woman that received the order is Kate Cox. She had requested the court to grant an order allowing abortion due to pregnancy related complications.

Paxton wrote a letter saying that the judge’s order doesn’t protect doctors from all abortion laws and questioned if Kate Cox qualified for an exception.

In a statement with the letter, Paxton emphasized that Guerra Gamble’s order wouldn’t protect hospitals, doctors, or anyone else from legal consequences for breaking Texas’ abortion laws.

The letter was directed to three hospitals where Dr. Damla Karsan, set to perform Cox’s abortion, holds admitting privileges.

Marc Hearron, a lawyer from the Center for Reproductive Rights representing Cox, mentioned that Ken Paxton relies on fear to enforce abortion bans. Hearron added that Paxton aims to rush legal processes, causing suffering for Kate and similar pregnant women.

On Tuesday, 31-year-old Cox from the Dallas-Fort Worth area took legal action by filing a lawsuit. She requested a temporary order to stop Texas from enforcing its almost complete abortion ban.

Cox explained that her ongoing pregnancy posed risks to her health and future ability to have children. Guerra Gamble confirmed she would grant this order during a Thursday morning hearing.
